Terms of Service for Seewe Chinese
These Terms of Service ("Terms") are a legal agreement between you and Havyn LLC, the developer and publisher of Seewe Chinese ("we", "us") governing your use of the Seewe Chinese iOS application and its lock-screen widget (together, "the App").
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App and delete it from your device.
1. The App
Seewe Chinese shows Chinese vocabulary on your lock screen and home screen, lets you make and import flashcard decks, helps you review them, and turns photos of Chinese text into cards. The App is free to download and use, and carries no advertisements. An optional subscription, Seewe Pro, is described in §2.
Your decks and progress live on your phone, and there are no accounts. The only things we receive are feedback you choose to send (see §5), and the App downloads a public list of trending phrases.
2. Seewe Pro (optional purchase)
The App is free. Seewe Pro is an optional purchase that unlocks the rest of the paper colours and doodles, adding your own doodles, the Trending tab, and unlimited photo scans. It is offered as an auto-renewing subscription and, where shown in the App, as a one-time lifetime purchase. Everything else — unlimited decks and cards, the widgets, the HSK lists, spaced repetition, and the first three photo scans each day — is free and stays free.
Purchases are made through Apple and billed to your Apple ID. Payment is taken when you confirm the purchase and, for a subscription, again at each renewal, unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription at any time in Settings → your name → Subscriptions on your device; deleting the App does not cancel it. Prices are shown in the App before you buy, in your local currency, and may vary by region. We do not process payments and never see your payment details, and refunds are handled by Apple under the App Store Terms of Service.
If a subscription ends, nothing you made is taken away: your decks, cards, review history, and the doodles you uploaded yourself are never removed or locked. The papers, doodles, Trending tab, and unlimited scans the subscription unlocks simply stop being available, and return if you subscribe again. A lifetime purchase does not expire.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as the App Store Terms of Service allow. This license is for your own use; it is not a sale of the App.
The App's source code is separately released under the MIT License. Any rights that license gives you to the source code are unaffected by these Terms, which cover the App as downloaded from the App Store.
4. What you may not do
You agree not to:
- use the App in violation of any applicable law or regulation;
- use the App to store, display, or distribute content that is unlawful, infringing, or that you do not have the right to use;
- misrepresent the App as your own product or remove attribution notices for third-party data included with it (see §8);
- attempt to interfere with the security or integrity of the App or of any device or system it runs on.
What you may do with the source code is set by the MIT License, not by this section.
5. Your content
Vocabulary you create, files and doodles you import, and photos you scan ("Your Content") remain yours. We don't claim any rights to them, since they stay on your phone and we never receive them.
Feedback. If you send us feedback from the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use it to improve the App — for example, to fix a bug or correct a definition you reported — without any obligation to you. Please don't include anything unlawful, abusive, or private about someone else. How we handle it, including your email, is in the Privacy Policy.
You are solely responsible for Your Content, including having the right to use any material you import, and for ensuring you do not place sensitive or private information into decks that will be displayed on your lock screen, where it may be visible to others without unlocking your device.
6. Backups and data loss
You are responsible for backing up Your Content. Your study data is stored on your phone. If you delete the App or lose or reset your device, your decks and progress can be lost for good. We have no copy and can't recover it. Use an iPhone backup (such as iCloud) if you want to keep it.
7. Third-party services
Distribution of the App is governed by Apple's App Store terms. Seewe Pro is sold by Apple, and we use RevenueCat to check that your subscription is active. Trending phrases and feedback are hosted by Supabase. We aren't responsible for these outside services and don't control them.
8. Third-party content and attribution
The App includes vocabulary data derived from third-party sources, used under their licenses:
- CC-CEDICT (definitions and pinyin), licensed under CC BY-SA 3.0. The derived vocabulary file distributed with the App is likewise available under CC BY-SA 3.0.
- complete-hsk-vocabulary (HSK levels and frequency ranks), subject to that project's own license terms.
Credits are shown in the App under Settings → Credits. These licenses apply to that data separately from these Terms.
9. Accuracy of content
Vocabulary definitions, pinyin, and text recognized from photos may be incomplete, ambiguous, or wrong. Reading text from photos is especially imperfect. The App is a study aid, not an authoritative dictionary or a translation service, and must not be relied on where accuracy matters — for example in academic, medical, legal, financial, or safety-critical contexts.
10. Availability and changes
We may modify, suspend, or discontinue the App, or any of its features, at any time and without notice or liability. We are under no obligation to provide updates, bug fixes, or continued compatibility with future versions of iOS.
11. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECT WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing in these Terms limits any non-waivable consumer rights you have under the law of your country of residence.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, OR STUDY PROGRESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR SEEWE PRO IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR USD $10.
13. Indemnification
You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising from Your Content, your use of the App, or your violation of these Terms or of any law or third-party right.
14. Apple-specific terms
You acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the App or its content. Accordingly:
- Apple has no obligation to furnish any maintenance or support services for the App. Support requests should be directed to us at the address in §18.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the App (the App itself is free; Seewe Pro is described in §2). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- We, not Apple, are responsible for investigating and defending any third-party claim that the App infringes that party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
15. Termination
These Terms apply until terminated. You may terminate them at any time by deleting the App. We may terminate your license if you materially breach these Terms. Sections 5, 6, 8, 9, and 11 through 17 survive termination.
16. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in California will have exclusive jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-law provisions or of the right to bring proceedings in the courts of your country of residence.
17. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the App.
We may update these Terms as the App changes. Material changes will be noted by updating the "Last updated" date above and, where appropriate, through in-app or App Store release notes. Continued use after a change means you accept the revised Terms.
